This Limited Warranty (“Warranty”) gives you specific legal rights and you may also have others which vary from state to state. Ethos Group, Inc. (“Warrantor”) does not authorize any person to create for Warrantor any other obligation or liability in connection with the Protection Products.

ANY IMPLIED LIMITED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE TO THE APPEARANCE CARE IS LIMITED IN DURATION TO THIS WRITTEN LIMITED WARRANTY. PERFORMANCE OF REPAIRS IS THE EXCLUSIVE REMEDY UNDER THIS WRITTEN LIMITED WARRANTY OR ANY IMPLIED LIMITED WARRANTY. WARRANTOR SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM BREACH OF THIS WRITTEN LIMITED WARRANTY OR ANY IMPLIED LIMITED WARRANTY.

Some states do not allow limitations of how long an implied limited warranty will last or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This Warranty is granted for the sole benefit of the original owner. This Warranty does not cover any economic loss or extra expense, including (without limitation), payment for the loss of time or pay, inconvenience, storage, loss of vehicle use, lodging, meals or other travel costs. Note: Any repair undertaken without written authorization of Warrantor will not be reimbursed.

ETHOS GROUP, INC. (“WARRANTOR”), PROVIDES THIS APPEARANCE CARE LIMITED WARRANTY (“WARRANTY”) FOR INTERIOR AND/OR EXTERIOR SURFACES TREATED WITH THE PROTECTION PRODUCTS INDICATED ON THE INVOICE. THE WARRANTY IS SUBJECT TO ALL TERMS AND CONDITIONS SET FORTH IN THIS DOCUMENT.

WARRANTY GENERALLY

Ethos Group, Inc. (“Warrantor”), provides this Appearance Care Limited Warranty (“Warranty”) for Interior and/or Exterior surfaces treated with the Protection Products listed in the Invoice. The Warranty is subject to all terms and conditions as set forth in this document. (There is no deductible for coverage under this warranty.) THIS AGREEMENT IS A LIMITED PRODUCT WARRANTY AND IS NOT INSURANCE. The purchase of this vehicle protection product is not a condition for obtaining financing for the purchase of a motor vehicle.

DEFINITIONS

1.“Protection Product(s)” means Paint Protector and/or Glass Protector. The Protection Product(s) indicated on the Invoice identify which of the Protection Products are applied to the Vehicle.
2. “Seller” means the dealership where the Warranty was sold/issued. Seller is not a party to the Contract. Seller is identified on the Invoice.
3. “Vehicle” means the vehicle identified on the Invoice.
4. “Warrantor”, “We”, “Us”, “Our” means Ethos Group, Inc., P.O. Box 140249, Irving, TX 75014- 0249 (855) 342-4970, who is the Warrantor to this Warranty.
5. “Warranty Purchase Date” means the date You purchase this Warranty.
6. "Warranty Purchase Price” means the price paid by You for this Warranty, indicated on the Invoice in the same section as the specific Protection Products.
7. “Warranty Term” means the period during which You are eligible for protection. The Warranty Term begins on the Warranty Purchase Date and expires at the end of the months indicated on the Invoice.
8. “You” or “Your” means the consumer identified on the Invoice.

PAINT PROTECTOR LIMITED PRODUCT WARRANTY

If Your indicated Protection Product includes “Paint Protector” then Warrantor guarantees any and all factory painted exterior surfaces treated with ‘Paint Protector’ against fading, oxidation, or loss of gloss caused by exposure to elements such as weather induced acid rain, road and sea salts, insects, bird droppings and tree sap. Warrantor reserves the right to attempt to remedy any such damages by means of professional reconditioning prior to repairing or repainting any surfaces.

GLASS PROTECTOR LIMITED PRODUCT WARRANTY

1. If Your indicated Protection Product includes “Glass Protector” or, then Warrantor guarantees the Vehicle’s windshield treated with ‘Glass Protector’ against chips, bullseyes, or cracks six (6) inches or less in length that are considered repairable using common windshield repair methods without replacement of the entire windshield. Warrantor is not obligated to provide windshield repair services for cracks or failures exceeding six (6) inches in length or diameter, or for cracks or bullseyes that are not repairable using common windshield methods.
2. The maximum number of repairs provided under this Warranty are five (5) per year of the Warranty Term.
3. If the Vehicle’s windshield is replaced during the Warranty Term, Warrantor will apply the applicable Protection Product(s) to the replaced windshield. THIS WARRANTY DOES NOT PROVIDE FOR REPLACEMENT COVERAGE OF THE WINDSHIELD.

WHAT YOU SHOULD DO (VEHICLE OWNER)

You should maintain the Vehicle with regular car washing and appearance maintenance as prescribed by your automobile manufacturer. Cleaning your Vehicle of bird waste, tree sap, and other contaminants will help eliminate possible damage. You must report any damage within 60 days following the notice of any such damage covered by this Warranty by contacting Warrantor as directed in the claim procedure outlined on the back of this Warranty. Failure to report damage within 60 days of noticing the damage will void coverage under this Warranty and relieve Warrantor of all legal responsibility. Warrantor is not obligated or responsible for general cleaning and maintenance of the vehicles paint or windshield surfaces. Regular care and cleaning are necessary.

REPAIR COMMITMENTS

1. Warrantor will review the claim for the damaged portion of the vehicle as long as the original owner makes such claim within the Warranty term.
2. Warrantor's sole obligation shall be to clean, repair and/or (for Paint Protector) repaint damaged surfaces and subsequently to reapply to the repaired surface. Warrantor’s obligations shall only be applicable for damage described in the “Limited Product Warranty” sections of this Warranty. Warrantor shall have the right before any other remedy to rebuff any paint damaged surface and such rebuffing may be considered a remedy. Warrantor shall cause all services to be performed with reasonable attention, quality and promptness. When possible, the selling auto dealer may be used to perform the remedy; however, if not possible, Warrantor will designate the new repair facility. Warrantor's liability is limited to the cost to repair damage as described in this Warranty. For exterior damage, due to the effects of aging and paint variations over time, matching paint colors of repaired components to the colors of the original vehicle is not always possible and not covered under this warranty.
3. THE AGGREGATE LIABILITY UNDER THIS WARRANTY FOR ALL CLAIMS SHALL NOT EXCEED $5,000 OR THE MOST CURRENT AVERAGE J.D. Power TRADE IN VALUE AT THE TIME OF THE CLAIM, WHICHEVER IS LOWER.

REGISTRATION OF LIMITED PRODUCT WARRANTIES

The registration of this Warranty is required except where such requirement is prohibited by state law. The original registration must be provided to Ethos Group, Inc., Attn: Appearance Care, P.O. Box 140249, Irving, TX 75014-0249 by the Seller within thirty (30) days of the date of application to initiate coverage.

HOW TO MAKE A CLAIM

Call Warrantor’s customer service information line at (855) 342-0323 for the complete procedure on how to file a claim, please have Your Warranty available when calling. If the claim is approved, the Warrantor will repair or replace as specified the damaged section of the Vehicle. Claims will only be paid to the original owner of original limited warranty. Any repair undertaken without written authorization of Warrantor will not be reimbursed. The owner of the Vehicle must report all claims within 60 days following the notice of any damage covered by this Warranty. Proof of ownership may be required. We reserve the right to request photos of any reported damage.

OBLIGATION TO PERFORM

The following provision only applies if this Warranty was issued to You in Arizona, Colorado, Georgia, Hawaii, Illinois, Indiana, Louisiana, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, Oregon, and Virginia. Warrantor’s obligation to perform under this Warranty is insured by a warranty reimbursement insurance policy issued by Titan Insurance Company, Inc., a Risk Retention Group, P.O. Box 140249, Irving, Texas 75014-0249, (888) 989-8127. In the event that Warrantor does not fulfill its obligations under this Warranty within sixty (60) days after Your request to Warrantor, then You may file a claim directly with the insurance company.

STATE AMENDMENTS

If issued in the referenced state, this Warranty is amended as provided below.

Hawaii
Unresolved complaints or questions concerning a registered warrantor may be addressed to the Department of Commerce and Consumer Affairs, 335 Merchant St, Honolulu, HI 96813, 808- 587-3222.

Indiana
This service contract is not insurance and is not subject to Indiana insurance law.

Massachusetts
THIS AGREEMENT IS A PRODUCT WARRANTY AND IS NOT INSURANCE.

Michigan
We may only cancel this warranty for (1) nonpayment of the purchase price, (2) Your material misrepresentation to us or the seller, (3) fraud by You, or (4) Your substantial breach of Your duties under this warranty. If we cancel this warranty, we will mail you written notice of the cancellation at Your last address in our records thirty (30) days prior to the effective date of cancellation stating the effective date of and reason for the cancellation.

Mississippi

Missouri
This Limited Warranty is not eligible for cancellation by You. We may only cancel this warranty for (1) nonpayment of the purchase price, (2) Your material misrepresentation to us or the Seller, (3) fraud by You, or (4) Your substantial breach of Your duties under this warranty. If We cancel this warranty, we will mail You written notice of the cancellation at Your last address in our records thirty (30) days prior to the effective date of cancellation stating the effective date of and reason for the cancellation.

Oregon
1. This Limited Warranty is not eligible for cancellation by You. We may only cancel this warranty for (1) nonpayment of the purchase price, (2) Your material misrepresentation to us or the seller, (3) fraud by You, or (4) Your substantial breach of Your duties under this warranty. If we cancel this warranty, we will mail You written notice of the cancellation at Your last address in our records thirty (30) days prior to the effective date of cancellation stating the effective date of and reason for the cancellation. 2. Unresolved complaints concerning a warrantor or questions concerning the regulation of a warrantor may be addressed to the Department of Consumer and Business Services, Department of Financial Regulation, Consumer Advocacy Unit at 350 Winter Street NE, P O Box 14480, Salem, Oregon 97309, or at 503-947-7984.

Virginia
If any promise made in this Warranty has been denied or has not been honored within sixty (60) days after Your request, You may contact the Virginia Department of Agriculture and Consumer Services, Office of Charitable and Regulatory Programs at www.vdacs.virginia.gov/foodextended-service-contract-providers.shtml to file a complaint.
